Political Dynamics of State Administration Law: An Analysis of Public Officials' Discretion and Protection of Citizens' Rights in Strategic Policies in Indonesia

This study analyzes the influence of political configuration on the character of state administrative legal products in Indonesia, especially in contemporary public policy. As a state of law (rechtsstaat), Indonesia places the law as commander-in-chief; However, in practice, the direction of legal politics is often the driving force that dominates the formation of regulations. Using normative legal research methods with a legislative approach and a case approach, this study examines how strategic policies such as the National Strategic Project (PSN) and the Job Creation Law test the principles of government administration. The results of the study show that the dominance of executive power causes public policies to tend to be pragmatic, centralistic, and more oriented towards economic efficiency and investment stability than the protection of people's rights and legal certainty. This condition results in a neglect of the General Principles of Good Governance (AAUPB), such as the principles of prudence, openness, and legal certainty. In addition, the implementation of discretion in the PSN shows an expansion of authority that has the potential to lead to abuse of authority (détournement de pouvoir), especially through acceleration procedures that ignore AMDAL and public consultation. This study also found that although the PTUN has been strengthened through Law No. 30 of 2014, the effectiveness of its supervision is still constrained by weak implementation of decisions and political resistance. Therefore, it is necessary to strengthen legal supervision, limit discretion, and increase public participation to maintain the principle of the rule of law
